Las Vegas Workers' Compensation Law

Workers' compensation laws are designed to protect employees. Employers are responsible to protect the safety of their workers. When someone is injured in an office accident, or develops an occupational disease, he or she should receive compensation.

If you or someone that you love is injured at work, the first step to recovering financial compensation is to seek medical attention. This will document your injuries. You also need to let your employer know immediately. To ensure that you recover the full amount of compensation owed to you by law, you should consult an experienced and qualified attorney.

The workers' compensation attorneys at the Las Vegas law firm of Benson, Bertoldo, Baker, & Carter have the skill and determination you need to get the compensation you deserve. Our attorneys can assist you with the original claim as well as appeals if necessary.

Overview of Rights

It is important to note that if you are injured while at work, you must give your employer written notice within 7 days after the accident or diagnosis of illness. Your employer should have the required form.

If you seek medical treatment, you will need to fill out the form "Claim for Compensation" C-4, which should be available at the place of treatment. A C-4 must be filed within 90 days of the accident. The physician that treats you must fill out the form and mail it in within 3 business days of initial treatment.

Should you require medical treatment, you might be required to choose a physician from a list that is given to you by your workers' compensation insurer, if it is contracted with an Organization for Managed Care (MCO) or Preferred Provider Organization (PPO). You might be able to choose the physician of your choice if your employer has not entered into contract with a MCO or PPO.

Overview of Benefits

The amount and type of workers' compensation benefits you receive will depend on several factors, including the type and severity of your injury, your wages, and your age. For instance, you might be entitled to the following:

  • Temporary Total Disability (TTD): If your doctor has certified that you cannot work for 5 consecutive days or 5 days in a 20-day period
  • Temporary Partial Disability (TPD): You might get TPD to make up for the difference in wage (if you receive less upon reemployment than you did before the accident)
  • Permanent Partial Disability (PPD): If an evaluation shows that you have permanent disabilities
  • Permanent Total Disability (PTD): If you are deemed permanently and totally disabled, you might qualify for monthly checks via PTD
