General Info - Wrongful Death
Wrongful deaths occur when a person is killed due to the negligence of some other person or entity (such as a company or organization). Surviving dependents or beneficiaries are typically the ones who file wrongful death claims. Laws known as "survival statutes" ensure that cases can be brought against others even after the death occurs. Before these laws existed, individuals could only obtain damages if they survived, or before they died.

Each state has a "statute of limitations" that applies to wrongful death cases. These statutes limit the time period in which a wrongful death lawsuit can be filed. In Las Vegas, and all of Nevada, the statute of limitations in wrongful death cases is generally six years from the time of death.
